Recently, the suicide of Atul Subhash, a 34-year-old AI engineer working in Bengaluru, has shaken the country. Atul has filed 9 cases against himself, ranging from dowry harassment to murder, to suicide. The Supreme Court has made an important comment on Monday amid the ongoing debate across the country regarding the suicide case of Bengaluru AI engineer Atul Subhash. The court has said that in a case of abetment to suicide, no one can be held guilty merely on the basis of harassment. A bench of Justices Vikram Nath and PB Varale made the remarks while hearing a petition challenging an order of the Gujarat High Court, which has quashed a woman’s husband and in-laws for allegedly harassing him and inciting him to commit suicide. The parties were refused acquittal.
This comment of the court is considered very important in view of the recent suicide case of 34-year-old engineer Atul Subhash from Bengaluru. It is noteworthy that Atul had accused his wife and her family members of harassment.After this, a case of abetment to suicide was registered against wife Nikita Singhania, her mother Nisha, father Anurag and uncle Sushil.
“It is a legal principle to prove the charge under Section 306 of the IPC that presence of the accused is necessary for a clear intention to instigate,” the bench said in its December 10 judgment.The bench said, ‘Without this, the requirement of proving abetment under the law is not satisfied.’
Making this comment, the bench acquitted all three people of charges under Section 306. However, it upheld the charge against the appellants under Section 498-A of the IPC. It noted that the woman’s father had filed an FIR against her husband and two in-laws for alleged offenses including sections 306 and 498-A of the IPC.
