The Supreme Court’s hearing today: More than 230 petitions filed to ban CAA rules!

On Tuesday, March 19, The Supreme Court will hear a batch of petitions which are seeking to ban the implementation of the Citizenship Amendment Act, 2019. Just a day after the Centre issued the rules under the CAA, the Kerala-based political party Indian Union Muslim League which is known as IUML appealed to the Supreme Court, seeking a stay on the implementation of the rules.

230 petitions have been filed seeking the ban of Citizenship Amendment Act!

A bench of Judges, like Chief Justice of India DY Chandrachud and justices JB Pardiwala and Manoj Misra took note of the submissions of senior advocate Kapil Sibal, who is appearing for the Indian Union Muslim League. The appeal says that once Indian citizenship has been granted to migrant Hindus, it cannot be taken back, and so an early hearing was warranted. Lok Sabha MP and AIMIM chief, Asaduddin Owaisi has also appealed the Supreme Court, seeking a stay on the implementation of the CAA.

The IUML has demanded that the controversial law and rules should be stayed and no coercive action should be taken against those from the Muslim community who are deprived of the benefits of this law. Not only IUML, other parties and many more individuals like Democratic Youth Federation of India (DYFI), Leader of Opposition in Assam Assembly Debabrata Saika, Congress MP from Assam Abdul Khaliq have also filed applications to bna this act.

The Citizenship Amendment Bill 2019 was passed in Parliament in way before in December 2019. The Lok Sabha passed the bill on 9 December, and the Rajya Sabha passed it on 11 December. The Citizenship Amendment Act is for those illegal immigrants who will not apply to certain areas. These include the tribal areas of Assam, Meghalaya, Mizoram and Tripura which is included in the Sixth Schedule of the Constitution. But the CAA will not be applicable in those states where ‘Inner Line Permit’ system is in force under Bengal Eastern Frontier Regulation 1873. The system of ‘Inner Line Permit’ is applicable only in Arunachal Pradesh, Mizoram and Nagaland.
