3 big points addressed by Jharkhand High Court
Jharkhand High Court said during the bail hearing – The entire case shows that the applicant is specifically or indirectly involved in the acquisition and possession of 8.86 acres of land as well as the “proceeds of crime” Not included. There is no indication of direct involvement of the petitioner in the acquisition and possession of the said land in any of the registers/revenue records.The High Court also said that if the petitioner (Hemant Soren) had acquired the said land in 2010 and was in possession of the same, he was not in power at that time, then the displaced persons from the land could have sought redressal of their grievance from the authorities. There was no reason not to contact.The High Court further said, the claim of the Enforcement Directorate (ED) that its timely action had prevented illegal acquisition of land by forgery and manipulation of records appears to be a vague statement when considered in the background of this allegation That the land was already acquired and occupied by the petitioner.
In the end, Jharkhand High Court said in clear words – “No harm is going to be caused by granting bail to the applicant”.
